1. Introduction & Company Information

These terms and conditions govern your use of harleyhousedistillery.co.uk and any purchase of products from Harley House Distillery Ltd (“we”, “us”, “our”), registered in England and Wales. By browsing our website or placing an order, you agree to be bound by these terms.

2. Alcohol Sales, Age Restrictions, and Challenge 25

You must be *18 years of age or older* to purchase alcohol from Harley House Distillery.

It is against the law for a person under 18 to buy or attempt to buy alcohol, or for an adult to buy or attempt to buy alcohol on behalf of a person under 18.

By placing an order containing alcohol, you confirm that you are aged 18 or over and are legally entitled to purchase the alcohol ordered.

Challenge 25

Harley House Distillery operates a *Challenge 25* policy.

If the person receiving or collecting an alcohol order appears to be under 25, they will be required to provide satisfactory proof that they are aged 18 or over before the alcohol is handed over.

Acceptable identification may include:

* a valid passport;
* a valid photocard driving licence;
* a proof-of-age card bearing the PASS hologram; or
* an approved digital proof-of-age method where legally permitted and accepted by our delivery provider or us.

Alcohol will *not* be handed over to anyone who:

* is under 18;
* appears to be under 25 and cannot provide acceptable proof of age when requested; or
* is believed to be attempting to obtain alcohol for someone under 18.

We and our delivery providers reserve the right to refuse delivery where age-verification requirements are not satisfied.

Where delivery is refused for this reason, the order may be returned to us. Reasonable additional delivery or return costs may be charged or deducted where legally permitted.

 

3. Orders & Contract Formation

Placing an order through our checkout represents an offer to purchase.

Our automated order acknowledgement email is a confirmation of receipt, not acceptance. The legally binding contract between you and Harley House Distillery is formed only when we dispatch your order and issue your Dispatch Confirmation email.

If a product becomes unavailable or an error in pricing occurs, we will notify you promptly and issue a full refund to your original payment method.

4. Pricing & Payment, and Products

We take reasonable care to ensure product descriptions, bottle sizes, alcohol strengths, photographs and prices are accurate.

As some of our spirits are handmade or produced in small batches, there may occasionally be minor variations in appearance, colour, packaging or labelling.

Products are subject to availability.

If an item becomes unavailable after you order, we will contact you and offer an alternative, revised delivery arrangement or refund.

5. Delivery Policy

Our standard delivery charge is currently *£6.25 per qualifying order*.

Any alternative delivery charge, free-delivery promotion, local-delivery arrangement, or collection option will be clearly displayed at checkout before payment.

We deliver only to locations made available through our checkout.

Estimated delivery times will be displayed or communicated during the ordering process. Unless otherwise agreed, goods will normally be delivered within 30 days.

Alcohol deliveries are subject to our *Challenge 25* policy.

Alcohol will only be handed to a person aged 18 or over. Anyone who appears to be under 25 will be required to provide acceptable proof of age before alcohol is handed over.

If delivery cannot be completed because:

  • Nobody eligible is available to receive the alcohol;

  • Acceptable proof of age cannot be provided when requested; or

  • Incorrect or incomplete delivery details have been supplied,

The order may be returned to us.

Additional reasonable delivery charges may apply where a failed delivery results from circumstances within the customer's control.

6. Consumer Right to Cancel & Returns (Consumer Contracts Regulations 2013)

14-Day Cooling-Off Period: You have the statutory right to cancel your purchase within 14 calendar days from the day you (or your designated recipient) receive the goods, without giving any reason.

Exercising Your Right: To cancel, email us at info@harleyhousedistillery.co.uk stating your order number and intention to return. You must dispatch the goods back to our distillery within 14 days of notifying us.

Condition of Returned Items: In accordance with hygiene and consumer safety regulations, returned spirits and consumable items must be unopened, undamaged, and retained in their original security seals and intact packaging. If the seal on a bottle is broken, your right to return is void unless the item is proven defective.

Return Shipping Costs: Unless an item was sent in error or arrived damaged, you are responsible for the direct cost of returning items to us via a tracked, insured courier service.

Refund Processing: We will issue your refund (including standard outbound shipping) within 14 calendar days of receiving the returned goods, or upon receipt of verifiable courier tracking proving their return.

 

7. Damaged, Defective, or Incorrect Goods (Consumer Rights Act 2015)

Inspection on Arrival: If an outer parcel arrives with obvious transit damage or leakage, you may refuse the delivery and instruct the courier to return it to us.

30-Day Right to Reject: If a bottle arrives damaged, defective, or contaminated, you have the statutory right to reject the goods within 30 calendar days of receipt for a full replacement or refund (including all postage costs).

Contacting Support: Contact info@harleyhousedistillery.co.uk with your order number and photographs of the damaged product. We will arrange a free return, replacement, or full refund.

8. Intellectual Property & Acceptable Use

All trademarks, logos, photography, graphics, and written content on this website are the intellectual property of Harley House Distillery Ltd or our licensors. You may not reproduce, copy, or distribute any material without our explicit prior written consent.

 

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Collection

Where collection is offered, details will be provided during or after checkout.

Anyone collecting an order containing alcohol must be aged 18 or over.

Our *Challenge 25* policy also applies to collections, and proof of age may be requested before alcohol is handed over.

11. Placing an Order

Before placing your order, you will have the opportunity to review your products, quantities, delivery details, total price and applicable delivery charges.

Placing an order constitutes an offer to purchase the goods selected.

You will receive electronic confirmation after placing your order.

We may refuse or cancel an order where, for example:

  • Payment cannot be authorised;

  • An item is unavailable;

  • There is an obvious pricing error;

  • We reasonably suspect fraudulent activity;

  • Age-verification requirements cannot be satisfied, or

  • Fulfilling the order would breach licensing or other legal requirements. If we cancel an order after taking payment, we will refund the relevant amount.

12. Statutory Right to Cancel

If you purchase goods from us online as a consumer, you will normally have a statutory right to change your mind under the Consumer Contracts Regulations.

You must tell us that you wish to cancel an eligible order within *14 days after the day on which you, or someone nominated by you, receive the goods*.

You then have a further *14 days* to return the goods to us.

To cancel, you must send us a clear statement confirming that you wish to cancel the contract.

A model cancellation form is available on request or through our Returns information. You do not have to use the form and may cancel by contacting us directly.

13. Returning Goods Following Cancellation

For a statutory change-of-mind return, goods should be returned:

  • Securely packaged;

  • With seals intact where reasonably possible.

  • In their original packaging, where reasonably possible, and

  • In a condition suitable for return.

You are entitled to inspect goods in the same way as you reasonably could in a shop.

If goods have been opened, used or handled more than reasonably necessary to establish their nature, characteristics and condition, we may make an appropriate deduction from the refund to reflect any reduction in value where permitted by law.

Unless the goods are faulty, damaged, incorrect, or not as described, you are responsible for the direct cost of returning them.

We recommend obtaining proof of posting or using a tracked delivery service.

14. Refunds Following Statutory Cancellation

For a valid statutory cancellation, we will refund:

* the price paid for the returned goods; and
* The cost of our standard delivery service.

Where our standard delivery charge applied to your order was *£6.25*, the standard outbound delivery refund will normally be £6.25.

If you selected a more expensive delivery service, we are not required to refund the additional amount above the cost of our standard delivery service.

Refunds will normally be made within *14 days of receiving the returned goods*, or earlier where satisfactory evidence is provided that they have been returned.

Refunds will normally be made using the original payment method.

We do not offer an additional goodwill return period beyond your statutory rights unless expressly agreed by us in an individual case.

15. Faulty, Damaged or Incorrect Goods

Your statutory rights in relation to faulty goods are separate from your statutory right to cancel an online purchase.

Goods supplied by Harley House Distillery must be:

* of satisfactory quality;
* fit for purpose; and
* as described.

If goods arrive faulty, damaged, leaking, broken, incorrect, or not as described, please contact us as soon as reasonably possible.

You do *not* lose your statutory rights simply because a bottle or package has been opened where opening it was reasonably necessary to discover the fault.

Depending on the circumstances, you may be entitled to:

  • a refund;

  • a replacement;

  • a repair where appropriate;

  • a price reduction; or

  • another remedy available under the *Consumer Rights Act 2015*.

Consumers generally have a short-term right to reject qualifying faulty goods within *30 days*, with further statutory rights potentially continuing beyond this period.

Where goods arrive damaged, we may ask for photographs of the goods and packaging to help us investigate the damage with our courier. This does not reduce your statutory rights.

Return costs for faulty, damaged, incorrect, or misdescribed goods will be met by us where required by law.

 

16. Personalised and Bespoke Products

The normal statutory right to cancel may not apply to goods that have been made to your specification or clearly personalised, such as specially commissioned labels, personalised bottles or bespoke products.

Where this applies, we will make this clear before the order is placed.

This does *not* affect your statutory rights where personalised or bespoke goods are faulty, damaged or not as described.

17. Promotions and Discount Codes

Promotions and discount codes may be subject to additional conditions, including expiry dates, minimum order values, or restrictions to particular products.

Relevant conditions will be made clear when the promotion is offered.

Unless stated otherwise, discount codes cannot be exchanged for cash or combined with other offers.

18. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or breach of your statutory consumer rights.

We are not responsible for losses that were not reasonably foreseeable when the contract was made.

If you purchase products as a consumer, we are not responsible for business losses arising from commercial use of those products.

19. Privacy and Cookies

We process personal information in accordance with applicable UK data-protection law, including the *UK GDPR* and *Data Protection Act 2018*.

Our website uses cookies and similar technologies. Where consent is legally required for non-essential cookies, those cookies will only be used after appropriate consent has been obtained.

If you have a problem with an order or our service, please contact us using the contact details displayed on our website.

Please provide your order number where possible so we can investigate the matter promptly.

Nothing in this section affects your statutory rights.

 

21. Governing Law

These Terms are governed by the laws of *England and Wales*.

Consumers resident elsewhere in the United Kingdom may also have rights under mandatory consumer laws that apply where they live and may be entitled to bring proceedings in their local courts where applicable.
